Derivation of the International Legal Status of Taiwan

Based on the Delineation of "Categories of Territory" found in U.S. Court Decisions

and Customary International Precedent regarding the Disposition of Territory after War

INTRODUCTION

Experts on Asian studies in general, and Taiwan studies in particular, often state that Taiwan’s international legal status is “unsettled,” or “undetermined.”

Executive Branch officials of the United States and many other leading world nations also frequently repeat this type of description when they happen to come across the topic of Taiwan.

But there is one thing that these commonly recognized “experts” generally fail to do.

What is that?

Well, they don’t spend any time or effort in making an investigation to clarify the underlying parameters of this “undetermined” status.

As a result, in the world today, no one really understands the meaning of the phrase

Taiwan’s international legal status is undetermined.

. . . . even though this phrase frequently appears in a wide variety of media!

HISTORY

Taiwan had been ceded to Japan in the 1895 Treaty of Shimonoseki. So, after 1895, Taiwan belonged to Japan. Indeed, the United States recognized Taiwan as an “insular area” of Japan in the 1922 Washington Naval Treaty.

But, here in the 21st century, Taiwan’s current legal status is the result of certain events which occurred in the mid to late 1940s and early 1950s.

What happened during this period, which resulted in Taiwan’s legal status becoming “undetermined” . . . . . ? Moreover, is there any precedent in world history for such a classification?

And, most importantly:

Can the underlying parameters of this “undetermined” status be fully clarified?

Yes, the sponsors of the twclarify Youtube Channel believe that the meaning of the phrase

Taiwan’s international legal status is undetermined.

can be clarified in a very precise manner.

CLARIFICATION

But in order to do this clarification, we must have a correct starting point for our investigations!

After some in-depth research, we have discovered one amazing fact. It is this:

The failure to comprehend the concept of an “undetermined” legal status, arises directly from the failure to understand the different categories of “territory” that exist under international law.

In order to remedy this problem, we have produced a 70 page Powerpoint presentation which derives the international legal status of Taiwan based on a careful analysis of the different "Categories of Territory" found in U.S. Court Decisions.

On the twclarify Youtube Channel, we produce high-quality videos and powerpoints which explain the truth of Taiwan's history and its legal status.

These videos are seen by researchers, professors, and government officials in North America, Europe, Japan, and other leading countries.

Our tenets are --

Taiwan does not belong to the PRC!
Taiwan does not belong to the ROC!

The Taiwanese people should fully understand the truth of Taiwan's legal status. Only then will they be able to control their own destiny!
